These Terms & Conditions ("Agreement") govern the provision of real estate media services (e.g., photography, virtual tours, floor plans) by 3D Casas LLC ("3D Casas," "we," "us," or "our") to the client ("Client," "you," or "your"). Cancellation/Reschedule Policy
Requests for cancellation or rescheduling must be received the day before a site visit by 5pm. After this deadline, a fee will be applied to cover employee time and trip expenses. For specific fee amounts and examples (e.g., standard rescheduling or add-ons like weekends), please see our Online Bookings page at https://www.3dcasas.com/online-bookings.
Weather
Weather is considered an act of God and we cannot know when or how it will affect the subject property at the time of shooting. In addition to this, different customers have different standards for what is acceptable to them or their clients, hence, we rely on our customers to keep an eye on the weather—we recommend using Weather.com for site-specific forecasts at https://weather.com—and reschedule the day before (see our rescheduling policy above). The only instance where we would reschedule at no charge is when our photographer cannot complete the task. We would reschedule for the next available time, to complete the work already undertaken. This policy enables us to keep our prices as low as possible, as opposed to having to charge more for every job to offset such rescheduling instances.
Turnaround Times
Typically we deliver the next business day, following the site visit. Floor plans and photo editing can sometimes take an extra business day. Since we're not open on Sundays and certain holidays, one should factor this in to determine when the final media will be delivered. For example, if the site visit happens on a Saturday, media will be ready the following Monday. Obviously, these delivery times may vary due to exceptional circumstances out of our operational control (e.g., internet outage, acts of God, etc.).
Trip Fees
We charge reasonable trip fees for areas that are outside our normal service areas. If a trip fee applies, and this is your first time asking us to service that area, we will quote you prior to undertaking the trip and work. We strive to keep our trip fees as low as possible to cover only our costs for employees' time and mileage expense. Trip fees may be collected in advance and are refundable if you cancel within our cancellation policy period.
Photo Licensing
All media produced by 3D Casas (photos, virtual tours, floor plans, etc.) is copyrighted by 3D Casas upon creation. For virtual tours hosted on Matterport, Matterport's copyright and licensing policies may apply and supersede those outlined here. The original client receives a non-exclusive, royalty-free license to use the media solely for marketing and promoting the specific property featured (e.g., listing websites, social media posts tied to the listing, print materials). This license is perpetual for that property but non-transferable to third parties without prior authorization from 3D Casas. Modifications to the media, such as applying virtual staging, editing, or alterations of any kind, constitute copyright infringement and are strictly prohibited.
For any use beyond the original property-specific marketing—such as resale, broader commercial applications, or use by third parties (e.g., other agents, buyers, or media outlets)—prior written authorization from 3D Casas is required. We review requests on a case-by-case basis. Please contact us at photos@3dcasas.com for licensing inquiries—we're happy to discuss options that fit your needs.
All the media including virtual tour links, photo links, etc., is hosted by 3D Casas for 6 months (though we typically retain it longer where possible), after that additional hosting/editing fees may apply to recover the media, some media might be lost without a possibility to recover. For virtual tours hosted on Matterport, hosting duration is based on the plan selected at booking and can be extended for a fee. We recommend immediately downloading the media and storing it on your hard drive or online storage platforms like Google Drive or Dropbox.
We recognize that it wouldn't be fair to sell media paid for by one customer to another customer (e.g., change of listing agent), so typically we don't do this without the first customer's consent or ask the new customer to hire us to take new media. The only exception is for floor plans. We will modify the floor plan to reflect the customer's information, but unless the property has been modified we won't measure it again unless we deem it necessary. Some media, such as virtual tours, are hosted by third-party vendors such as Matterport who have their own copyright that may supersede ours.
Custom Edits and Usage Guidelines
3D Casas delivers media as accurately captured during the site visit, enhanced with the industry standard flambient style editing for lighting, color correction, and clarity to show the property in the best possible way. Upon Client request, we may perform custom edits (e.g., virtual staging, color adjustments like "greener grass," or other enhancements). However, the Client is solely responsible for requesting, reviewing, and approving any custom edits, and for ensuring all media use—edited or otherwise—complies with applicable laws, ethical standards, and real estate disclosure requirements. This includes avoiding any misrepresentation of the property (e.g., no alterations to imply conditions that do not exist). Any post-delivery modifications by the Client may violate copyright (see Photo Licensing). 3D Casas disclaims responsibility for claims arising from Client-requested edits or subsequent misuse; see Indemnification for details.
Floor Plans Disclaimer
Floor plans provided by 3D Casas are for marketing purposes only, illustrating the general layout of the property. ALL MEASUREMENTS ARE APPROXIMATE. This document may not be used to determine the valuation of the property or estimate repairs or improvements. We are not licensed appraisers, surveyors, or engineers, and square footage calculations are a courtesy provided at the agent's request based on on-site observations and client-provided information—they may vary from official appraisals or county records. ALL PARTIES USING THIS DOCUMENT AGREE TO TAKE THEIR OWN MEASUREMENTS IN ORDER TO DETERMINE THE LAYOUT AND SIZE OF THE PROPERTY. 3D Casas disclaims any liability for inaccuracies, errors, or omissions in floor plans, and the Client is responsible for verifying measurements for any legal, financial, or contractual use. See Limitation of Liability for related protections.
Limitation of Liability
3D Casas LLC shall take reasonable care in performing its services. However, Client understands and agrees that 3D Casas is not responsible for accidental damage to property or its contents during a site visit. In any event, the maximum liability of 3D Casas, whether in contract, tort, or otherwise, arising from or related to the services provided shall not exceed the total fee paid by Client for the specific job giving rise to the claim. 3D Casas shall not be liable for any indirect, incidental, special, or consequential damages, including loss of use, lost profits, diminution in property value, or claims by third parties, even if 3D Casas has been advised of the possibility of such damages. Nothing in this Agreement limits liability for gross negligence, willful misconduct, or other liabilities that cannot be excluded under applicable law.
Indemnification
The Client agrees to indemnify, defend, and hold harmless 3D Casas LLC, its officers, directors, employees, and agents (collectively, "3D Casas") from and against any and all claims, demands, actions, costs, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) the Client's provision of access to the property or any information/materials for the services; (ii) any breach of this Agreement by the Client; (iii) any third-party claims resulting from the Client's use, distribution, or modification of the delivered media; or (iv) any hazards, defects, or conditions on the property during the site visit (including failure to warn of dangers like pets, unsecured areas, or sensitive information). This indemnification obligation survives termination of the Agreement. 3D Casas' total liability under this section shall not exceed the fee paid for the specific job, consistent with the Limitation of Liability above. In a reciprocal manner, 3D Casas agrees to indemnify the Client against claims directly arising from 3D Casas' gross negligence or willful misconduct in performing the services, subject to the same fee cap.
